NOTE. In this instance of the submitted 2300759B Condition 7 Tree Planting Plan, 2300759B Condition 7 Tree Planting Proposal and 2300759B Condition 8 MWT Working Method Statement submitted on the 15.03.2024 and 2024-019-102 Rev A Ballamaddrell Cottage - Soft Landscaping and Pedestrian Path Detail submitted on the 15.05.2024 and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the following planning conditions of application 23/00759/B:
o Condition 6 with the understanding that the hard landscaping works shall be completed in full accordance with the approved details prior to the first occupation of the dwellings hereby permitted.
All further planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwelling, whichever is the sooner.
Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
o Condition 7 with the understanding that any retained tree which within five years of the approved development being occupied or completed (whichever is the later) dies, are removed or become seriously damaged or diseased shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting season or

o Condition 8 with the understanding that the development shall not be carried out other than in accordance with the submitted Method Statement.

This decision is related to the submitted 23/00759/B Condition 7 Tree Planting Plan, 2300759B Condition 7 Tree Planting Proposal and Condition 8 MWT Working Method Statement submitted on the 15.03.2024 and 2024-019- 102 Rev A Ballamaddrell Cottage - Soft Landscaping and Pedestrian Path Detail submitted on the 15.05.2024.

Officer’s Report
1.0 Description
1.1 The proposed application 23/00759/B for the alterations to previously approved planning application 22/00473/B with a glazed link to modern two storey extension to rear was approved on 11.03.2024 subject to 8 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Conditions 6, 7 and 8 which the applicants are seeking to satisfy.
1.3 Specific wording of the conditions are as follows:
'C6: No development shall take place until full details of soft and hard landscaping works have been submitted to and approved in writing by the Planning Department and these works shall be carried out as approved.
Details of the hard landscaping works to include details of landscaping/pedestrian paths to the front of the dwelling, driveways, parking and turning areas, and patio area shall also be provided. The hard landscaping works shall be completed in full accordance with the approved details prior to the first occupation of the dwellings hereby permitted.
All further planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwelling, whichever is the sooner.
Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
Reason: To ensure the provision of an appropriate landscape setting to the development.'
'C7: No development shall be commenced until an Updated Tree Plan prepared in accordance with the recommendations of British Standard BS5837:2012 (Trees in relation to Design, Demolition and Construction) has been submitted to and approved in writing by the Department. Such a scheme shall include details of all trees and other planting which are to

24/10029/AIR be retained; a planting specification to include numbers, species and positions of all new trees and shrubs; and a programme of implementation.
Any retained tree which within five years of the approved development being occupied or completed (whichever is the later) dies, are removed or become seriously damaged or diseased shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting season or in accordance with a programme of replacement to be agreed in writing with the Department.
Reason: To safeguard the existing trees and planting to be retained within the site.'
'C8: Prior to any works commencing on the site, a Precautionary Working Method Statement for lizards, breeding birds and Schedule 8 plants, written by a suitably qualified ecological consultancy, shall be submitted to and approved in writing by the Department.
The statement shall include the provision of a new hibernacula feature for lizards in a sunny spot close to a boundary hedge or wall. The development shall not be carried out other than in accordance with the submitted Method Statement.
Reason: To provide adequate safeguards for the ecological species existing on the site.'
2.0 Proposal
2.1 The applicant's agent have now submitted 2300759B Condition 7 Tree Planting Plan, 2300759B Condition 7 Tree Planting Proposal and 2300759B Condition 8 MWT Working Method Statement submitted on the 15.03.2024 and 2024-019-102 Rev A Ballamaddrell Cottage - Soft Landscaping and Pedestrian Path Detail submitted on the 15.05.2024. These documents provide details information on the soft landscaping for the development as well as the hard standing, a tree planting proposal by Manx Roots which covers the updated tree plans including method of implementation and after care and a precautionary working method statement by Manx Wildlife Trust which covers potential roost features, bat and bird box plans and lizard hibernaculum.
3.0 Consultation
3.1 The following consultee's were consulted for advice on the satisfaction of condition: 3.2 The Ecopolicy Officer was consulted and the advice received on 07.05.2024, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses. 3.3 DEFA Forestry Officer was consulted and the advice received on 10.05.2024, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation
4.1 In this instance of the submitted 2300759B Condition 7 Tree Planting Plan, 2300759B Condition 7 Tree Planting Proposal and 2300759B Condition 8 MWT Working Method Statement submitted on the 15.03.2024 and 2024-019-102 Rev A Ballamaddrell Cottage - Soft Landscaping and Pedestrian Path Detail submitted on the 15.05.2024 and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the following planning conditions of application 23/00759/B:
