Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason.
The proposal is considered to comply with General Policy 2, Environment Policy 35 of the Isle of Man Strategic Plan 2016, Planning Circular 1/98 and Planning Policy Statement 1/01 and is supported. Although the frame materials are not traditional, as required by Environment Policy 34 they are considered appropriate in this case given the context of the site and that the general impact would be to preserve the character and appearance of the area

Officer’s Report THE APPLICATION SITE
1.1 The application site is within the curtilage of the Laxey Sailing Club, Tent Road which is a detached single storey structure to the West of Tent Road. - 1.2 The front elevation has three windows which are one over two casements and one door which is solid with a glass top light. THE PROPOSAL
2.1 The current planning application seeks approval for the replacement of the existing three timber windows situated to the front elevation with uPVC replacements with the same opening pattern, and replacement of the existing front door with a solid panelled uPVC door. PLANNING HISTORY - 3.1 There are no previous application situated upon the site which are relevant to the assessment of this application. PLANNING POLICY - 4.1 The site lies within an area zoned as "Mixed Use" on the Area Plan for the East, Map 7 Laxey. The site is within a Conservation Area and a High Risk Flood Zone (Tidal). Directly in front of the site along the main road is the Raad Ny Foillan coastal walk.
4.2 Given the nature of the of the land designation and the property being within a Conservation Area, Section 18(4) of the Town and Country Planning Act (1999) is the most relevant in the assessment of this application. Followed by paragraph 7.29.2 and Environment Policy 35 of the Isle of Man Strategic Plan, which set out development in Conservation Areas will only be permitted where they preserve or enhance the character and appearance of the area. - 4.3 Due to the proposal being situated within a Flood Risk Zone, Environment Policy 10 is also relevant which seeks that where a proposal is deemed within a flood risk zone, a flood risk assessment is required.

6.1 The main issues to consider in the assessment of this planning application are:
7.1 The proposed windows and door are deemed acceptable in terms of their form, mass and design which will ultimately preserve the overall Conservation Area and Streetscene, as such the proposal complies with Section 18(4) of the Town and Country Act (1999) and Environment Policy 35 of the Isle of Man Strategic Plan 2016.
