It has come to my attention that the owners of 16 Brewery Wharf, Castletown IM9 1EU (“16 Brewery Wharf”) have submitted an application for planning permission for the erection of a car port at 16 Brewery Wharf (the “Planning Application”). The reference number for the Planning Application is 24/00355/B and it seems that the application form in connection with the Planning Application is dated 21 March 2024.

My husband, and I own the property 14 Brewery Wharf, Castletown IM9 1EU (“14 Brewery Wharf”). Jason and I also own, along with the owners of other properties at Brewery Wharf, Castletown IM9 1EU (“Brewery Wharf”), a shared area to the rear of Brewery Wharf (the “Shared Area”). Part of the Shared Area is to the rear of 16 Brewery Wharf and abuts the land which is the subject of the Planning Application.

and I own a garage and a parking space at the rear of 14 Brewery Wharf which can only be accessed via the Shared Area. In addition, the door on the rear elevation of 14 Brewery Wharf can only be accessed via the Shared Area. and I have been expressly granted rights of way (both vehicular and on foot) over the Shared Area.

In light of the above, should you decide to approve the Planning Application, I would be grateful if you would please make such approval conditional upon the owners of 16 Brewery Wharf not obstructing or in any way interfering with the rights of way which and I enjoy over the Shared Area.
