NOTE. In this instance of the submitted documents and after consultation with the Case Officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 10 of application 16/01372/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.

Officer’s Report
1.0 Description 1.1 The proposed application (16/01372/B) for alterations and additions to form restaurant, commercial units and four apartments and erection of flue was approved after appeal on 17.07.2017 subject to 10 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition (10) which the applicants are seeking to satisfy.
1.3 Specific wording of the condition as follows:

25/10021/AIR The development hereby approved shall not be brought into use until a hard and soft landscaping scheme has been submitted to and approved in writing by the Planning Authority to include details of all walls, fences, trees and other planting and boundary treatment and finished ground levels, a planting specification and a programme of implementation.
All hard and soft landscaping works shall be carried out in accordance with the approved details and programme of implementation. Any trees or plants which, within a period of five years from the date of planting, die, are removed or become seriously damaged or diseased shall be replaced during the next planting season with other trees or plants of a species and size approved in writing by the Planning Authority. All hard landscape works shall be permanently retained in accordance with the approved details.
Reason: To ensure an appropriate landscape setting and screening to the development and in the interests of visual amenity.
2.0 Proposal 2.1 The applicants have submitted documents outlining the planting finish with an application form on the 10.01.2025.
2.2 The proposed plan outlines some changes to be made to the soft landscaping for the purposes of drainage.
2.3 The applicant has requested to remove requirement for low level planting to rear of commercial unit, as this impacts on old drainage & the sub - base in this area is old concrete. It is stated that current decorative stone chippings provide essential outside space for tenants.
2.4 The applicant has requested to remove the requirement for the second tree to the rear of the building, as this impacts on drainage & right to light to lower apartment.
3.0 Recommendation 3.1 In this instance of the submitted documents and after consultation with the case officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 10 of application 16/01372/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
