Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
This application has been recommended for approval for the following reason. The proposal does not increase impacts on the character and streetscene of the area and neighbouring amenities. It is considered to comply with General Policy 2 (b) (c) (g), Environment Policy 22 and Environment Policy 42 of the Strategic Plan and the Residential Design Guide.
Plans/Drawings/Information; This approval relates to the documents, location plan and drawing no. 1690 -1, 1690 - 2, which have all been received on 29th February 2024.

1.0 THE SITE 1.1 The application site is Hillview, Ocean Castle Drive, Port Erin, a single-storey detached house located on the east end of Ocean Castle Drive.
2.0 THE PROPOSAL 2.1 The proposed is the erection of a single-storey pitched-roof rear extension. It has a bi- fold door on the south elevation and windows on the east elevation. It has no openings on the north elevation.
3.0 PLANNING HISTORY 3.1 There is no previous application considered materially relevant to this application.
4.0 PLANNING POLICY Site Specific 4.1 The site is within an area designated as predominantly residential in the Area Plan for the South.
Strategic Policy 4.2 The Isle of Man Strategic Plan 2016 (IOMSP) contains the following policies that are considered materially relevant to the assessment of this current planning application: o General Policy 2 (b) (c) (g) o Environment Policy 42
4.3 The Isle of Man Strategic Plan has no assumption in favour of new development. In decision-making, approval should usually not be granted where a planning application conflicts with the Plan.
4.4 General Policy 2 (b), (c) and (g) and Environment Policy 42 set out design requirements for development, of which they should respect the character of the site itself and its immediate and not-so-immediate surroundings.
4.5 General Policy 2 (g) and (h) set out that amenities enjoyed by the site and the site around it should be protected or preserved.
4.6 General Policy 2 (h) (i) also sets out that the proposal should satisfy the safety, efficiency, and accessibility requirements, including parking provision, of all highway users whenever possible.
PPS and NPD 4.8 No planning policy statement or national policy directive is considered materially relevant to this application.
5.0 OTHER MATERIAL CONSIDERATIONS Strategy and Guidance 5.1 The Residential Design Guide July 2021 (RDG) contains the following guidance that are considered materially relevant to the assessment of this current planning application: o Chapter 7 Impact on Neighbouring Properties
5.2 The Residential Design Guide was issued by the Department of Environment, Food and Agriculture (DEFA) in July 2021 and was agreed with the Minster of DEFA. It provides clear guidance on acceptable forms of residential extensions and alterations.
6.0 REPRESENTATIONS This section is a summary. The original texts of the consultations and comments received are available on the Planning Application Search on the government website. 6.1 Port Erin Commissioners has no objection to this application (13.03.2024).

6.2 DoI Highway Services does not oppose this application. (11.03.2024). The comment states that there is no significant negative impact upon highway safety, network functionality and/or parking.
6.3 Manx Utilities wrote in (18.03.2024) for surface water discharge details.
7.0 ASSESSMENT Elements of Assessment 7.1 The key considerations of this application are its impact on: o character and streetscene of the area o amenities of the neighbouring properties o surface water
Character and Streetscene and the Area 7.2 The proposal is considered to have no negative impact on the character of the area.
Neighbouring Amenities 7.3 The proposal is of moderate size and is not considered to create additional overbearing or overshadowing impacts.
7.4 There are fences around the site, so the proposal is not considered to create additional overlooking impacts.
Surface Water 7.5 The proposal only wildly increased hardening areas compared to the existing houses. Therefore, the additional surface water discharge is not considered to be a sufficient reason for recommending refusal.
8.0 CONCLUSION 8.1 The proposal does not increase impacts on the character and streetscene of the area and neighbouring amenities. Therefore, the proposal is considered to comply with General Policy 2 (b) (c) (g), Environment Policy 22 and Environment Policy 42 of the Strategic Plan and the Residential Design Guide, and it is recommended for an approval.
9.0 INTEREST PERSON STATUS 9.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land which the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status.
