NOTE. In the instance of the submitted application for the discharge of conditions, a Bin Storage Plan and a Cover Letter and after consultation with the case officer, who is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 7 of application 17/00947/B with the understanding that the bin store shall be constructed in accordance with the approved details.

1.0 Description - 1.1 The proposed application 17/00947 for the demolition of existing building and erection of a 72 bedroom residential care home with associated car parking, access, landscaping and highway alterations was approved at appeal on 26.03.2018 subject to 13 conditions some of which required submission of additional information prior to the commencement of works. - 1.2 This report is specific to Condition 7 which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition as follows:
"C7 Prior to the occupation of the building hereby approved, details of the design and appearance of the bin store shall be submitted to and approved in writing by the Planning Authority, and the bin store shall be constructed in accordance with the approved details.
Reason: To protect the character and appearance of the development."
2.0 Proposal - 2.1 The applicant's agent have now submitted an application for the discharge of conditions, a Bin Storage Plan and a Cover Letter which show the proposed layout and location for the 3 1100L bins as well as images showing the type of bin to be used. The proposal includes hedging on the wall between the pavement and the bin store ensuring that the bins are hidden away from public view. The agent has also confirmed there will be a dropped kerb at the entrance to ensure moving the bins to the lorry will avoid any lifting on and off the road to the pavement.
3.0 Consultation - 3.1 Port Erin Commissioners was consulted for advice on the satisfaction of condition. The advice received on 24.01.24, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation - 4.1 In the instance of the submitted application for the discharge of conditions, a Bin Storage Plan and a Cover Letter and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 7 of application 17/00947/B with the understanding that the bin store shall be constructed in accordance with the approved details.
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
