9th October 2020 Dear Sir/Madam, Application No: 20/00907/LAW Proposal: Application for certificate of Lawful Use of existing detached garage as ancillary living accommodation Address: The Lodge Ballaquaggan Farm Douglas Road Ballasalla Isle Of Man IM9 3AD Applicant: Dr John Taylor OBE
With regard to the above application, I write to advise that the Department has declined your request for a Certificate of Lawfulness under the provisions of section 24 of the Town and Country Planning Act 1999. The following reason(s) have been given:
- It is not considered that there has been submitted sufficient evidence to demonstrate that the garage shown in the submitted plans has been used for ancillary living accommodation (or indeed any form of living accommodation) and as such a Certificate of Lawfulness should not be issued.
Please note that there is no right of appeal against this decision. Should you have any queries relative to this matter please contact this Department at your earliest convenience. Yours faithfully
