The above application has been considered by Douglas Borough Council, subsequent to which the Council has concluded to raise the following points for consideration by the Planning Authority when determining this application.
The supporting documentation appears to be incorrect in as such that the site does not have any live approved planning applications. There have been 4 previous applications to develop the site. The last application 15/00723/B was approved on the 25th August 2015 and expired August 2019. The applicant states that in light of the extant planning permission, it has already been established that the site is suitable for redevelopment. The Council does not disagree on the principles of the site being suitable for development but given all previous applications have now expired, any new proposals to develop the site would require a new application and approval from the Planning Authority. The Council believes that it is incorrect for the applicant to state that the use of the site as a temporary car park in relation to the extant planning permission on site (15/00723/B) will not hinder the future development of the land; the Council believes that the use of the land for car parking has hindered the development of the site and will continue to do so as long as the site is being used as a car park.
The site has already been used as a car park for over the recommended twenty-four month period, as such if PA 19/01188/LAW is approved, Douglas Borough Council would request that this approval should be for a maximum period of 24 months whereupon the use of the land as a car park must cease to accord with the COMIN directive on
temporary car parks and to coincide with recent approvals for temporary car parks within the Borough of Douglas.
We trust that consideration will be given to the points raised within and that the matters relating to statements regarding the current validity of planning approval for the development of the site will be brought to the attention of the applicant.
