Tel 01624 685950 Kelly Lewthwaite Building Design 23 Market Street Douglas IM1 2PA TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to REFUSE an application by Cheeseden Investments Limited, Ref 19/00448/B, for the Alterations and extension to existing tholtan to form dwelling at Kates Cottage Ballnahowe Road Ballnahowe Port Erin Isle Of Man for the following reason(s): 1. Although an argument could be made that the existing building is of sufficient interest to warrant its retention and conversion, the extent of the structural works required to make the structure sound coupled with the unacceptable upwards extension, the overbearing rear extensions, the inappropriate modifications to the apertures and spread of hard standing and domestic curtilage would have a significant and adverse impact on the original appearance, character, historic interest and materials of the original building contrary to General Policy 3 (b) and Housing Policy 11. 2. There is no information to demonstrate that potable water can be provided for the site contrary to Housing Policy 13 (c). 3. The proposed alterations and extensions and the subsequent introduction of large areas of hard standing would result in an unacceptable visual impact on the wider rural landscape and countryside setting of the site contrary to Environment Policy 1 and paragraphs 8.10.1 and 8.10.2 4. There is insufficient information available to understand the impact of the development on the adjacent watercourse contrary to Environment Policy 7. This decision refers only to that applied for under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Whilst a copy of the Officer’s report is included alongside this notice, any wider correspondence which led to the assessment and decision is now available to view on the Government’s website (via Online Services) or at the Department’s offices Murray House, Mount Havelock, Douglas. https://www.gov.im/planningapplication/services/planning/search.iom Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the current Fees Order; · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
