28 August 2019 · Delegated - Principal Planner Abigail Morgan
Field 434773, Grenaby Road, Ballasalla, Isle Of Man, IM9 3bd
The proposal involved retaining three mobile open-fronted timber shelters, each approximately 3.7m x 3.1m in plan, 2.9m high to apex and 2.4m to eaves, placed in a grazing field on the eastern side of Grenaby Road as part of an agricultural and equestrian holding.

The officer determined there was no sufficient agricultural or equestrian need for the shelters to outweigh the general presumption against development in the countryside, an area of High Landscape Va…
Environment Policy 1
Presumption against development in undesignated countryside areas. Officer assessed that no agricultural need outweighed this presumption for the shelters.
Environment Policy 2
Requires protection of countryside character as the most important consideration in High Landscape Value and Scenic Significance areas. Shelters harm open character despite small scale, visible from footpath.
Environment Policy 19
Equestrian development permitted only if no loss of amenity, high quality land or highway capacity issues. No such losses but overall need and character tests failed.
Environment Policy 21
Prohibits animal shelters detrimental to countryside character in siting/design/size/finish; must reflect purpose without cavity-wall construction. Basic timber shelters inappropriate in exposed rural setting without justifying need.
General Policy 3
Exceptions to presumption against countryside development include essential agriculture (GP3f). Assessed as not essential, failing to justify structures away from existing building groups.
Environment Policy 15
Agricultural buildings permitted if need outweighs presumption against development, sited near existing groups, sympathetic in scale/form/materials. Remote siting and lack of need failed tests.
no highway interest in the application
Multiple public representations strongly object to the retrospective application for three mobile shelters citing lack of demonstrated agricultural need, while Malew Parish Commissioners defer pending further information and DOI Highways have no interest.
Key concern: lack of demonstrated agricultural need

ObjectionWe would like to formally object to this Planning Application; the inspector agreed that "It has not been demonstrated that there is agricultural need, as provided for in an Environment Policy 15 for the three shelters to overcome the general presumption against development as set in General Policy 3 and Environmental Policy 1, The Strategic Plan."

ObjectionJust what agricultural purpose they are to be used for ?; To say that they would need shelter from the elements whilst in a lowland valley is quite honestly ridiculous; If they are not going to be used for genuine agricultural purposes then they should be removed
Garey Rhennie
ObjectionI write to object to the retrospective planning application; all the Committee agreed there was NO agricultural need for the shelters; When does this madness end? In my eyes this makes a mockery of the planning system.

ObjectionWe strongly oppose this application; these shelters have been refused at every level of planning as it has not been demonstrated that there is agricultural need
