Key concern: unsafe and inadequate highway access with delivery vehicles crossing centreline
DEFA Inland Fisheries
Conditional No ObjectionPrecautions will be needed to reduce the possibility of harmful materials such as concrete or sediment entering the stream during these works.; The applicant is advised to contact Fisheries (tel. 685857, or email [email protected]) to discuss method statements, should the proposal be granted planning approval.

Reason: To protect the aquatic and bankside habitat, and to avoid the risk of injury or disturbance to fish within the river.; A construction method statement should be submitted to and approved in writing by the Department prior to the start of construction of the path, of the culvert along the north eastern boundary and of any embankment works. The method statement should outline a suitable construction approach to reduce the possibility of disturbance of fish within the stream. ObjectionHighways are therefore objecting to this application on the grounds of unsafe and inadequate access, and also lack of parking.; the applicant would not be able to get a S109 agreement as the highway officers... are already aware that this 2017 site access layout is unacceptable.
Manx Utilities Authority
Conditional No ObjectionManx Utilities Authority has assessed the above planning application and would like to advise you that the Authority has no objection to the application subject to the following condition/s
Conditions requested: detailed operation and maintenance programme submitted for temporary Sewage Treatment Plant; drainage infrastructure remains private until connected to public system and temporary plant decommissioned; communication fee payable per property connected per Sewerage Act 1999
The original application sought full approval for a residential and retail development on a site previously approved in principle (15/00775/A) and via reserved matters, with minor amendments to house designs, retail unit orientation, and site extension for future foul drainage connection. Marown Parish Commissioners appealed the Planning Committee's approval, arguing abuse of process, overdevelopment, excessive retail size, unnecessary drainage changes risking environmental harm and development creep, and inadequate conditions. The inspector conducted a hearing on 25 July 2019 and site visit on 22 July 2019, finding the changes acceptable compared to the fallback position of prior approvals, no harm to character or environment with conditions, and recommending dismissal. The Minister accepted this, upholding approval on 10 October 2019 with 19 conditions securing landscaping, drainage method statements, highway safety, retail controls, and public safety fencing.
Precedent Value
Establishes that minor variations (house types, unit handing, drainage routing) on commenced sites are assessed narrowly against fallback; conditions effectively mitigate construction/environmental impacts; complex histories best resolved via full reapplications for clarity, but cannot block acceptable schemes.
