Environment Policy 35
Requires development in Conservation Areas to preserve or enhance character/appearance and protect special features. Officer found minor external changes (rooflights, extraction duct, door) acceptable as building is not prominent, changes tucked away, and outdoor dining enhances vibrancy without harm.
Strategic Policy 4
Proposals must protect/enhance fabric/setting of Registered Buildings/Conservation Areas and avoid unacceptable pollution/disturbance. Assessed as compliant due to limited changes, maintenance of building, and no adverse impact on nearby Registered Buildings' setting.
General Policy 2
Requires development not to adversely affect townscape, residential amenity, highway safety, parking, or adjoining land. Officer confirmed compliance: no amenity harm from noise/odour (conditions mitigate), parking relaxed per town centre policy, safe access, supports Mixed Use zoning.
Transport Policy 7
Provides parking standards but allows relaxation in town centres, near public transport, or for Conservation Area benefits. Relaxed here due to public car park proximity, bus/rail access, no worsening of existing office parking demand, and unsafe on-site manoeuvring.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Restaurant hours
No customers may remain within the restaurant premises outside the following hours: 1200 - 1430-hrs and 1800 - 2200 hrs. Reason: to control the impact of the restaurant on nearby residential property.
Extraction system approval
Prior to the installation of any external extraction system, details of this, including noise and odour emission levels and measures for their mitigation, must be approved by the Department and the development undertaken in accordance with these details. Reason: to protect the amenities of those living near to the site.
