General Policy 2
Requires development to respect site and surroundings in siting, scale, design; not adversely affect amenity, character, highway safety, or parking. Officer assessed design sympathy, amenity separations (20m privacy, 25-degree shadowing), 3-space parking, and minimal street scene impact as compliant.
Environment Policy 42
Prohibits inappropriate backland development harming character/identity or removing green spaces. Officer found Victorian detailing sympathetic to locality, angled lower building acceptable despite backland nature, and no visual harm to street scene.
Transport Policy 4
Highways must accommodate development traffic safely. Officer noted prior approval precedent and adequate rear lane access with 3 turning spaces, overruling objections.
Transport Policy 7
Requires parking per standards (2 spaces/unit). Proposal provides 3 spaces to rear, exceeding requirement; condition ensures retention.
Strategic Policy 1
Encourages efficient use of under-used land utilising infrastructure. Site is under-used rear land in residential area with services.
Strategic Policy 2 - Priority for new development to identified towns and villages
Prioritises development in towns/villages. Site in Douglas, zoned Predominantly Residential.
Housing Policy 4
New housing in towns. Compliant as urban infill site.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Parking retention
The parking area to the north of the dwelling hereby approved shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times. Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety.
no objection to the proposal
Ealing Court Management Limited objected to the application citing impacts on light, privacy, access, road safety, servicing, fire access, and drainage; Douglas Borough Council (Dilapidation Enforcement Officer) had no objections.
Key concern: service lane access inadequate for vehicles, pedestrians, emergency services, lacking manoeuvring space, lighting, and legal rights
Ealing Court Management Limited
Objectionthis application fails to address g, h, i, j and m [of General Policy 2]; The service lane does not have public lighting which will further increase hazards of cars and pedestrians using the service lane for access; This is not safe for the pedestrians using the lane; ECM have not been consulted by the developers, apart from the rear party wall
