Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Housing Policy 6, Transport Policy 4
The application is proposing to convert an former shop with living accommodation into two dwellings. The site is located within an area zoned as predominantly residential within the Douglas Local Plan 1998. The principle of the usage is considered compatible with the land use zoning.

In terms of parking, the application site proposing to provide one garaging space for each of the dwellings within the existing rear extension. The Highways Division do not oppose the application. It is consider the provision of a space for each of the dwellings to be beneficial.
In respect of the external alterations to the building, the application site is not within a Conservation Area. The external alterations are relatively minor and would not adversely affect the visual amenities of the locality.
The only concern with the proposal is that one of the properties will not have any amenity space. In order to provide such space would require demolishing the existing rear extension, which would result in the loss of accommodation and garaging. On balance, it is considered the none provision of a rear yard for the dwelling is not critical, as many rear yards in the area are used to store their bins and this application is proposing to provide a space within the garage for the bin. It is considered the proposal is acceptable.
It is recommended that planning permission be granted subject to conditions.
The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Highways Division of the Department of Transport is now part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.
The Manx Electricity Authority and the Environmental Health Officer of the Department of Environment, Food and Agriculture have commented on non-planning matters and as such should not be afforded party status.
The Environmental Health Officer of the Department of Environment, Food and Agriculture has not commented on planning matter and as such should not be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the conversion of existing buildings into two residential dwellings with associated garages as shown in drawing numbers HLK/10/0298/1, HLK/10/0298/2, HLK/10/0298/3, and HLK/10/0298/4 date stamped 13th December 2010.
C 3. No facing materials shall be used other than materials similar to those used on the existing building.
I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
