Officer’s Report
THE SITE 1.1 The site is the residential curtilage of a mid terraced property in Castletown at the north eastern end of The Crofts. The property is a two storey plain fronted cottage with a pitched roofed dormer in the front plane and four windows, three of similar size - one to the right of the front door and two at first floor level with a fourth which is slightly smaller, in the dormer. All of these windows are uPVC framed casements.
1.2 The other properties in the row of four have timber framed sliding sashes.

THE PROPOSAL 2.1 Proposed is the replacement of these with uPVC framed sliding sashes subdivided into two equal halves, one on top of the other. The windows will have a single, vertical glazing bar fitted externally.
PLANNING POLICY 3.1 The site lies within an area of Residential use on the Area Plan for the South (2013) and within Castletown's Conservation Area. As such, there is a requirement for development to preserve or enhance the character or appearance of the Area as set out in EP35 of the Strategic Plan and PPS 1/01. Guidance on the replacement of windows within Conservation Areas is also given within Planning Circular 1/98 as follows:
"If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.
Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction."
PLANNING HISTORY 4.1 Planning approval was granted for alterations and a rear extension (17/00599/B).
REPRESENTATIONS 5.1 Highway Services have no highway interest in the application (15.02.19).
ASSESSMENT 6.1 The proposed replacements would reinstate the original style of opening and whilst framed in uPVC, as are the existing, the new opening style would be a considerable enhancement to the character of the property itself and the terrace as a whole.
CONCLUSION 7.1 The proposal complies with EP 25 and PPS1/01 as well as PS 1/98 and is supported.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
