This Design and Access Statement should be read in conjunction with the following drawings and supporting documents:
This Design and Access Statement supports a detailed Planning Application for consent for the change of use of existing ancillary residential / tourist unit to a self-contained residential unit at Clyeen, Douglas Road, Kirk Michael, Isle of Man IM6 1AU.
The application site is located along the Douglas Road approximately 1.5 km south of Kirk Michael village. The current property is accessed via a shared private lane and consists of a large house with attached converted barn and a detached converted barn which is being used as ancillary residential and tourist accommodation. There is also a detached outbuilding on the site and a covered barbeque area.
The site is designated as being in an area of high landscape or coastal value and scenic significance in the 1982 Development Plan. The existing residential curtilage is approximately 2.6 acres. There is also an additional field 234353 under the same ownership which is approximately 3.7 acres. The curtilage of the site is well defined by mature trees, is not visible from the main highway and is surrounded by agricultural land.
There are 3 relevant planning application records for the site which have been found on the Isle of Man Public Access System. PA 99/01987/B Alterations and extension to dwelling and alterations to barn PA 00/01952/B Alterations and extensions to dwelling PA 03/01298/C Additional use of ancillary barn to tourist accommodation
The relevant policies against which to assess this proposal contained within the Isle of Man Strategic Plan 2016 are:

Use The proposal seeks to change the use of an existing detached barn so that it can be used as a self-contained residential unit. The current use is as ancillary living accommodation to the main house or as tourist accommodation.
Access will remain the same as for the existing tourist unit accessed off the private driveway with the existing 2 parking spaces and outbuilding / garage remaining.
Layout / Siting It is proposed that the curtilage of the proposed residential dwelling would be along the centreline of the courtyard between the main house and the existing barn. The curtilage would include the part of the garden and track to the south east of the barn and the existing outbuilding.
Scale / Appearance The scale and appearance are to remain the same as the existing building. The proposals would not adversely impact environmental, agricultural or highways interests, they would not adversely affect the countryside or its ecology and would not harm the character and quality of the landscape.
Access There would be no separate highway access or need to make any alternations to the existing access point. The proposals would not create any additional traffic and the proposed site would contain adequate car parking.
The applicant has been diagnosed with a life threatening and potentially terminal illness and needs to put his affairs in order.
The applicant has three children and the purpose if the application is to allow a split to be made of his assets. The main house and attached barn are subject to a separate and concurrent application.
In the event that the applicant does not recover from his illness, the split will allow for his intentions to be carried out without complicated, costly legal procedures.
It should not be considered as a new dwelling in the countryside as it already provides approved living accommodation and the clarification of use is sought to allow the estate to be cleanly separated into individual parcels.
The building is fully serviced and does not require any works to allow the use to be implemented.
The applicant is mindful that his circumstances are unusual and asks that full consideration be given to his situation.
