THIS APPLICATION IS REFERRED TO THE PLANNING COMMITTEE AT THE REQUEST OF THE HEAD OF DEVELOPMENT MANAGEMENT
THE SITE 1.1 The site is the footprint of an existing public shelter situated on the south eastern side of Shore Road. The shelter has behind it a grassed bank which incorporates a footpath link up to

Dandy Hill. A dwelling, Sea Breeze sits across the lane: this is a modern bungalow with underbuilding and a flat roofed garage to the west. Port Erin beach sits on the other side of the promenade.
1.2 The shelter is one of two on this part of the promenade. They are both the same and have partly open sides, partly glazed frontage with split stone faced pillars splitting the building visually into three equal parts all under a wavy sheeted roof. There is a row of seats inside the building offering its occupants a view of the sea.
THE PROPOSAL 2.1 Proposed is the conversion of the shelter into a building for the storage of paddleboards and will be managed by Port Erin Paddleboards Ltd which is a new company set up with help from the Department for Enterprise Micro Business Start up Scheme and were formed in 2017.
2.2 The works to the building include the following:
enclosing the building by inserting timber panels above the existing windows in the front and sides of the structure introducing doors at each end replacement of the existing struts at each end of the building.
2.3 The panels will be rendered.
2.4 Signage is to be introduced on the front above the glazing but will need to be the subject of an application under The Control of Advertisements Regulations 2013 and the applicant has been advised of this.
PLANNING POLICY 3.1 The site lies within an area designated on the Area Plan for the South Area Plan for the South as Mixed use and within the village's proposed Conservation Area identified in the Area Plan.
3.2 There are no policies which are specifically directed at works to public facilities. However, General Policy 2 contains the following advice:
General Policy 2: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality; (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space; (i) does not have an unacceptable effect on road safety or traffic flows on the local highways and (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan."
PLANNING HISTORY 4.1 There is no planning history relevant to the current proposal.
REPRESENTATIONS 5.1 Port Erin Commissioners support the application (10.04.19).

ASSESSMENT 6.1 The current structures are not particularly attractive in themselves but play a part in the character of the streetscene. They are not in particularly good repair and the local authority have advised that they are not particularly well used. In any case, there is another shelter in close proximity. If converted, the shelters could be reverted back to their original use simply by removing the side doors and signage.
6.2 The works proposed would improve the appearance of the structure without losing its character and would provide a use for it which is closely associated with the nearby shore and sea. There is not likely to be any impact from the works nor the use for storage. There is ample nearby on-street car parking to accommodate any vehicles which would visit the site.
CONCLUSION 7.1 It is considered that the proposal accords with GP2 and is supported.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
