Tel 01624 685950 Mr Anthony Faragher Grand View 4 Mount Morrison Peel IM5 1PN TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Anthony Faragher, Ref 19/00675/B, for the Reinstallation of metal access stairs / rails from garden to rear garage roof and installation of glazed balustrade above existing garage at Marina Cottage 17 - 18 Shore Road Peel Isle Of Man IM5 1NH and subject to compliance with the following condition(s) and notes (if any): 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. There shall be no external storage of items on the roof terrace hereby approved. Reason: To protect the visual amenity of the Conservation Area. 3. The balustrades (including all hand rails and vertical railings) hereby approved shall be finished in a dark colour and the glazing installed in a dark grey or black coloured tint, unless otherwise approved in writing by the Department and retained as such thereafter. Reason: In the interest of visual amenity. 4. In the event that the roof terrace is no longer required or is not used for a period longer than 12 months, whichever is the sooner, the balustrades and stairs shall be removed and the roof of the garage made good. Reason: to prevent the unnecessary retention of the roof terrace in the interest of visual amenity. This approval relates to site location plan, photographs of the existing site and photographs detailing the proposed development all date stamped and received 12/06/2019. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: Payment of a planning appeal fee as prescribed in the current Fees Order; The reasons for making the appeal; and An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
