The officer assessed whether sufficient agricultural need outweighed the general presumption against development in the countryside per General Policy 3 (GP3) and Environment Policy 1 (ENV1), and whet…
General Policy 3
GP3 establishes presumption against development in countryside except where sufficient need for agricultural buildings (exception f). Officer found agricultural need proven by applicant's land (4.65ha owned +18ha interest) and livestock (20 sheep existing, 30 beef cows planned), overriding presumption. Existing agricultural use of field supported this.
Environment Policy 1
ENV1 protects countryside from development. Proposal accepted as replacement shed improves visual impact by being less prominent than existing poor quality roadside structure.
Environment Policy 15
ENV15 permits agricultural buildings where need established and sited/designed appropriately. New shed's siting away from road, olive green sheeting, and demolition of existing met policy tests for minimal landscape harm.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Agricultural use only
The building must be used only for agricultural purposes. Reason: The countryside is protected from development and an exception is being made on the basis of agricultural need. As such the building must be used for the purposes for which it is approved.
Demolition of existing shed
Within 28 days of the completion of the approved building, the building annotated as to be demolished on the submitted plans, must be demolished and the site made good with all demolition material removed from the site. Reason: To accord with the proposed works and to enhance the character and appearance of the countryside.
