A Registered Building is a building of special architectural or historic interest which has been included in the Department's Protected Buildings Register.
It is an offence to carry out any works (internally or externally) affecting the character of a Registered Building without the written consent of the Department.
An up to date list of the Register is available from the Department or its website.
An application to de-register a building under Regulation 7, must state the reasons for making the application.

The former Farmers Combine Warehouse at 33 West Quay, Ramsey ('the building") was included on the Protected Buildings Register ("the Register") on 14th February 2019. That registration followed the process specified by Regulation 6 of the Town and Country Planning (Registered Buildings) Regulations 2013 ("the Regulations"). In the course of that process the owner of the building ("the owner") made representations to the Department to the effect that the building should not be registered. In registering the building the Department concluded that the building was one of special architectural or historic interest.
This application is presented by the owner in accordance with Regulation 7(1)(a) of the Regulations and seeks de-registration of the building.
The wider context of this application is that prior to registration the owner made an application for planning permission to demolish the building and re-develop the site (Application PA 18/00833/13).
In making representations in opposition to the Department's proposal to register the building, the owner drew the Department's attention to a report dated October 2018 which it had commissioned from BWB Consulting. The conclusion reached by BWB Consulting in that report was summarised in a letter from BWB to the Department dated 28th November 2018 in the following terms:- " ...having regard to the extent of alteration to building, in combination with deterioration and loss of original fabric, it [the building] fails to meet the level of special architectural or historic interest in the national context to merit addition to the [Register]. This is, of necessity, a high test and requires robust consideration and selectivity." The BWB report and the accompanying letter are produced with this application and are referred to for their terms. The advice contained within those documents remains the professional advice available to the owner.
In addition the owner commissioned a Structural Appraisal of the building from Graham Schofield Associates, Consulting Civil and Structural Engineers. Its report dated July 2018 together with appendices are produced with this application and are referred to for their terms. The writer of that report concluded that "old buildings such as this one experience structural deterioration as a result of two factors:- 1. Abuse and neglect of the building during its functional lifetime ... and 2. Ingress of water and gaps opening up to the building's fabric to allow natural weathering to occur." (para. 2.5). A Structural Assessment Report prepared by The Morton Partnership, Consulting Civil and Structural Engineers, dated September 2018 was commissioned by the Department.
The writer of that report concluded, inter alia, that "the building could be brought back into full use but at a high cost" and noted that necessary work would include the removal of the roof, principal rafter ends repaired and then reinstalled on partially rebuilt upper walls, the repair and strengthening of floor boards, joists and beams to support whatever floor loading was required and that floors and walls would require to be adequately tied together to prevent further movement and the walls repointed to prevent further water ingress. It was observed that experience suggested that the noted defects and repairs would likely not be exhaustive. The Morton Partnership report is also produced with this application and referred to for its terms. 6. Since the writing of both the Graham Schofield Associates and the Morton Partnership reports, the portal frame to the east of the building has been removed. A further report/letter from Graham Schofield Associates will be produced giving further details of the dangerous condition of the building which is more evident since the removal of the portal frame on the eastern elevation of the building. 7. The owner has consulted Ramsey Commissioners and has been advised that having considered the reports commissioned by the owner, the Commission is of the view that "the building has no integrity, no future viable purpose and no historic merit" and that on that basis the Commission agreed unanimously to withdraw support for the registration of the building. A letter to that effect from T.P. Whiteway, Town Clerk and Chief Executive, dated 5^{\text {th }} March 2019 is produced with this application and is referred to for its terms. 8. The owner has also received an email dated 26^{\text {th }} February 2019 from David Dorricott, on behalf of the Directors of Quay House Management Ltd (being the residential unit to the west of the building) expressing concern about the "very poor condition" of the building and vermin infestation of the building. He also observed that contrary to the suggestion that the building had historic value, there were "multiple, farbetter preserved properties along West Quay". That email is produced with this application and is referred to for its terms. 9. As the Department was not required to give detailed reasons for its decision to register the building on 14^{\text {th }} February 2019, it is not known to what extent the Department had regard to the representations made by the owner, and, in particular, the reports from BWB and Graham Schofield Associates. Nor is it apparent how the Department arrived at its
conclusion that the building is of special architectural or historic interest. 10.It is the owner's submission that (a) the building does not have any special architectural or historic interest; (b) that the property is structurally in a poor condition and is beyond economic refurbishment; (c) that the building does not contribute to its current setting on West Quay: and (d) the continued registration of the building acts as a potential impediment to the beneficial development of the building and the adjoining site. In the event that the building were to be demolished the owner would undertake to maintain a record of the building and preserve any item of interest such as the hoist gear and housing. 11.For foregoing reasons the owner respectfully submits that, on the basis of a full consideration of the relevant issues, the building should be removed from the Register.
