Description: Installation of external steps suitable for ambulant disabled access to side elevation (in association with registered building application 18/01138/CON)
Highway Comments: The application is to install external steps on the public highway to facilitate ambulant but not full disabled access to the adjacent public house. A S109 Highway Agreement would be required to undertake changes on the public highway but it is considered inappropriate to alter the highway without achieving full disabled access. In addition, the proposals would not benefit other users of the public highway in the vicinity of the site and would be detrimental by creating a highway obstruction.
Disabled access from the public highway to adjacent private premises should only be created by altering the existing highway levels to achieve a maximum gradient no steeper than 1:12 which may require an extensive area of the existing footway to be relaid.
It should be noted that nothing can be placed on the adopted highway without permission and therefore any seating, planting, signage, etc. currently on the highway associated with the public house must be permanently removed to avoid potential highway enforcement action.
Summary
Highway Services oppose the application as the proposal would not facilitate full disabled access and would be detrimental to other highway users. A S109 Highway Agreement will not be granted for developments on adopted highway land subject to a highway objection.
