Note where the application has suggested 2 or more uses, operations or other matters, the plan which accompanies the application shall indicate to which part of the land each such use, operation or matter relates.
It is requested that three copies of this application form and all supporting statements and plans are forwarded to the address below.
The Department may by notice in writing require the applicant to provide such further information as may be specified to assist in its consideration of the application.
On validation of the application, the Department will issue a Notice to the Local Authority and any such person as noted in answer to section 4 of this form. The Notice will invite written representation as to the content of the application. If necessary the Department will advertise this application by way of the weekly planning publication list.
Under Section 24(4) of the Town and Country Planning Act 1999, any person who for the purpose of procuring a particular decision on an application for a certificate: a) knowingly or recklessly makes a statement which is false or misleading in a material particular; b) with intent to deceive, use a document which is false or misleading in a material particular; c) with intent to deceive, withholds any material information; is guilty of an offence and may be liable: a) on summary conviction to custody for a term not exceeding 6 months or to a fine not exceeding £ 5000, or both; b) on convictions on information to custody for a term not exceeding 2 years, or to a fine, or both.
Please note that the Department retains powers under Section 24(5) of the 1999 Act, Section 5 of the Regulations, to revoke a certificate.
I am applying for retrospective planning for UPVC windows that were fitted at the rear of 2 Roslyn Terrace prior to me purchasing the house. The windows were fitted in approx. 2002 and the UPVC windows are only at the rear of the property. I have provided photos of the windows from the outside of the house and also the insert from within the windows which I believe shows the date they were produced.
I bought the house from my father 41 / 2 years ago and he believes they were fitted in 2002. He believes he did not need planning permission to do this at the time as he has indicated he was informed he only needed planning permission for windows at the front of the property. He did apply for planning to install windows in the front of the house in 2002 but this was declined and the original windows remain at the front.
When I bought the house the advocates I used did not pick up on the potential need for planning for these windows otherwise I would have addressed this before now.
I have provided the questionnaire that my father filled out for the advocates at the time of purchase that indicates the windows were fitted at approx. 2002
