In consideration of the evidence provided in support of the abovementioned application, the Department has determined to issue a Certificate of Lawfulness, herewith enclosed.
There is no appeal against the issue of this certificate, however should later contradictory evidence be established the Department retains powers to revoke its issue, in accordance with section 24(5) of the Town and Country Planning Act 1999.

The Department of Environment, Food and Agriculture hereby certifies that on the 26th January 2018, the use described in Schedule 1 to this certificate in respect of the land specified in Schedule 2 to this certificate and edged RED on the plan attached to this certificate, was lawful within the meaning of section 24 of the Town and Country Planning Act 1999 for the following reason:
This decision was made by the Head of Development Management under the Government Departments Act 1987, in the name of the Minister and/or in the name and on behalf of the Department.
This Certificate of Lawfulness for the change of use applies to the use of the lower ground floor, including the yard area to the rear of the property, as 'managers living accommodation'; one bedroom (No.1), a kitchen and a small store room on the ground floor; three bedrooms, two singles (No. 2 & 4) and a double (No.3), and a shower room on the first floor; and two bedrooms, one single (No.5) and one double (No.6), a large store room for use by the tenants, a store cupboard for the managers use and a shower room on the second floor.

This certificate is issued solely for the purpose of section 24 of the Town and Country Planning Act 1999.
It certifies that the use specified in Schedule 1 taking place on the land described in Schedule 2 was lawful, on the specified date and, thus, would not have been liable to enforcement action under section 26 of the 1999 Act on that date.
This certificate applies only to the extent of the use described in Schedule 1 and to the land specified in Schedule 2 and identified on the attached plan. Any use which is materially different from that described or which relates to other land may render the owner or occupier liable to enforcement action.
The effect of the certificate is also qualified by the proviso in section 24(3) of the 1999 Act, which states that the lawfulness of a described use or operation is only conclusively presumed where there has been no material change, before the use is instituted or the operations begun, in any of the matters relevant to determining such lawfulness.
