In this instance of the submitted application for the discharge of condition 19 and supporting detail and after consultation with DOI Highways, who are happy with the level of detail provided, the submission is deemed sufficient to achieve the desired outcome and would be considered satisfactory in meeting the requirements of the planning condition 19 of application 20/01467/B.

PA 20/01467/B - Erection of a building to provide exhibition space, retail, apartments and restaurant with associated parking spaces (relating to PA 19/00373/A), Marine Biological Station Breakwater Road Port Erin Isle Of Man IM9 6JA
SATISFACTION OF CONDITION 19
DESCRIPTION 1.1 This approval was granted on the condition, inter alia, that:

23/10125/AIR Prior to the commencement of development details of the proposed security barriers (rising bollards) positioned at access point 3 serving Block A as shown on Studio RBA's No: RBA_224_(90)_A101 P01 named Ground Floor External Works uploaded on 18 August 2021 shall be submitted to and approved in writing to the Department.
The security barriers/bollards shall be carried out in accordance with the report so agreed, and shall be retained as such thereafter.
Reason: to ensure that any nuisance caused by vehicle queuing onto the highway is minimised.
2.0 PROPOSAL 2.1 The applicant has provided information to satisfy this condition: notably, Agent's Statement on the Rising Bollards to satisfy condition 19 (dated 5 October 2022);
2.2 This document:
a. Identifies the Condition that is being satisfied;
b. Makes reference to the specific drawing which shows the bollards and provides excerpts which show their positions on the approved plan (Drawing No. RBA_224_(90)_A101 P01).
c. Shows details of the particular type of rising bollards that would be installed within the scheme; including mode of operation, type of mechanisms that guide its operation, time it takes to ascend and descend, position from the highway (11m) and reason for the positioning, diameter (101mm), height (500mm), and foundation depth (925mm). This also details the manufacturer of the bollards (ATG Access).
d. The link to the ATG Access site which is provided in the submitted document provides technical details of automatic bollards manufactured by ATG Access, such as the one being proposed within the current scheme.
3.0 ASSESSMENT 3.1 Condition 19: Rising Bollards 3.1.1 DOI Highways has provided a written statement via an email dated 15 October 2023 which confirms that the information provided appears suitable to discharge condition 19. They have, however, provided a reminder to the applicant that whoever would use this access would need to be provided with a suitable operator for the bollards at all times that they require access.
3.1.2 The document submitted to satisfy condition 19 has addressed all the requirements of the condition as it would ensure that any nuisance caused by vehicle queuing onto the highway is minimised, as required by the condition.
3.1.3 Therefore, it is considered that the submitted details provided to address this condition are appropriate and meet the requirements of this condition.
4.0 RECOMMENDATION 4.1 The Agent's Statement on the Rising Bollards (dated 5 October 2022) satisfies 19, although this condition will not be fully satisfied until such times as the works indicated on the document have been carried out in full and retained as such.
