In this instance of the submitted application for the discharge of condition 5 as well as a Passive House Planning Application (PHPP) and after consultation with DEFA Building Control, who are happy with the level of detail as the PHPP stated that the dwelling house achieved a Passive House Classic highlighting its eco efficiency, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 5 of application 19/01441/B.

Officer’s Report
1.0 Description
1.1 The proposed application 19/01441/B for the erection of a dwelling was approved on 02/03/2020 subject to 5 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition 5 which the applicants are seeking to satisfy.
1.3 Specific wording of the condition as follows:
"C5. Prior to the commencement of the development hereby approved, an Energy Statement shall be submitted and approved in writing by the Department which demonstrates the new dwellings has a Standard Assessment Procedure (SAP) rating of at least 97 (or similar rating system) and prior to the occupation of the dwelling a further Energy Statement post completion shall be submitted to and approved in writing by the

23/10121/AIR Department (planning) to demonstrate that the SAP rating of at least 97 (or similar rating system) has been achieved.
Reason: the reason why the application is considered acceptable is due to the overall environmental impacts as outlined on Housing Policy 14 and namely the eco efficiency credentials of the new dwelling"
2.0 Proposal
2.1 This application looks address the second part of the above condition by submitting its eco efficiency credentials post completion. The applicant has now submitted an application for the discharge of condition 5 as well as a Passive House Planning Application (PHPP) for the measurements of energy efficiency of the dwelling.
3.0 Consultation
3.1 DEFA Building Control was consulted for advice on the satisfaction of condition. The advice received on 08/11/2023, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation
4.1 In this instance of the submitted application for the discharge of condition 5 as well as a Passive House Planning Application (PHPP) and after consultation with DEFA Building Control, who are happy with the level of detail as the PHPP stated that the dwelling house achieved a Passive House Classic highlighting its eco efficiency, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 5 of application 19/01441/B.
