The original application PA 19/01324/B for erection of a detached dwelling was refused by the Department for Environment, Food & Agriculture. The appellant, M P Associates Ltd (on behalf of Ravenhill Resources Ltd), appealed the decision. Mr Rob Callister MHK, delegated decision-maker, considered the report of the appointed person, concurred with its conclusions, and accepted the recommendation to allow the appeal. The refusal was reversed, and the application was approved subject to 8 conditions addressing archaeology, trees, construction access, waste, landscaping, lighting, ecology, and compliance with drawings. The decision was issued on 29 January 2021.
Precedent Value
This appeal demonstrates that providing comprehensive technical reports and scheme revisions can lead to a successful outcome on appeal in the Isle of Man, even after initial refusal, particularly when the decision-maker concurs with the appointed person's positive recommendation.
