Officer’s Report

1.0 Description 1.1 The proposed application 22/00828/B for the construct three storey building with retail use (Class 1.1) at Ground Floor and residential use (Class 3.3) at First and Second Floors, with rooftop terrace was approved on 17.01.2023 subject to 4 conditions one of which required submission of additional information prior to the commencement of works.

1.2 This report is specific to Condition 4 which the applicants are seeking to discharge.

1.3 Specific wording of the condition as follows:

"C 4. No development shall commence until details of the method of opening and closing all of the windows in the building hereby approved have been submitted to and approved in

23/10059/AIR writing by the Department and the development shall only be carried out in accordance with details approved.

Reason: In the interests of the appearance and character of the site and surrounding area."

2.0 Proposal 2.1 The applicant's agent have now submitted an application form and drawing 265 022 Window openings [100 A4L] which shows elevations of the proposed building and how the windows will open.

3.0 Recommendation 3.1 In this instance of the submitted application and drawing of the buildings showing how the windows will open and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be satisfactory to discharge the planning condition 4 of application 22/00828/B.
