Note. In relation to Condition 3 of the approval, the submitted details (Application, Cronk Dhoo Arboricultural Method Statement and TP-020523 Cronk Dhoo Plot received 05.05.23), are deemed sufficient to achieve the desired outcome as recommended by the case officer and would be satisfactory to partially discharge the planning conditions No. 3 of this planning application. The condition requires the AMS to be adhered to in full.

Officer’s Report
1.0 Description 1.1 The proposed application 21/01478/A for the approval in principle for the creation of a residential curtilage for a dwelling addressing means of access was approved on 6th May 2022 subject to 5 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition 3 which the applicants are seeking to discharge.
1.3 Specific wording of the condition as follows:

Prior to the construction of the access to this building plot hereby approved an Arboricultural Method Statement (AMS), adhering to the recommendations of BS5837:2012 (Trees in relation to design, demolition and construction - recommendations), shall be submitted to and approved in writing by the Department. The AMS should confirm what protection measures are going to implemented, how and when they are they are going to be implemented, and how Arboricultural site monitoring will take place throughout the construction process, in sufficient detail to provide a high level of confidence in the outcome for retained trees. The agreed protection measures and construction methods shall be adhered to in full.
Reason: to provide a level of technical detail sufficient to provide a high level of confidence in the outcome for retained trees on the site due to their registered nature."
2.0 Proposal 2.1 The applicant have now submitted a submitted a Arboricultural Method Statement which shows protective measures to be adopted, how and when they are to be implemented, as well as how monitoring will take place throughout the construction process. Also included is a site plan for protective fencing locations.
3.0 CONSULTATION 3.1 The Forestry Officer in DEFA was consulted for advice on the satisfaction of condition on 05.05.23. The advice received 10.05.23 after their review of the submitted documents concludes that they are pleased to confirm that the information satisfies the relevant clauses.
4.0 Recommendation 4.1 In this instance of the submitted Arboricultural Method Statement as well as the Site Plan of protective fencing and after consultation with the Forestry Officer, who are happy with the level of detail provided, it is deemed sufficient to achieve the desired outcome and would be satisfactory to discharge the planning condition 3 of application 21/01478/A.
