N. Officer’s Report
1.0 Description 1.1 The proposed application 21/01368/B for the replacement of existing vehicle test centre building with construction of a new industrial building was approved on 19th July 2022 subject to 12 conditions some of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition 8 & 9 which the applicants are seeking to discharge.
1.3 Specific wording of the conditions as follows:

Prior to the commencement of development a details shall be submitted to and approved in writing of the proposed ecological mitigation outlined in the Technical Note: Ecological Mitigation Plan) (including the specifications and locations of bat and bird boxes, bug hotels, the bike shelter and the butterfly garden, as well as Schedule 8 plant eradication plans and details about the sensitive grassland management regimes), timescales for implementation and proposed maintenance measures. The development shall take place in accordance with the approved details and be retained as such thereafter.
Reason: to ensure that the mitigation measures are implemented in the interests of biodiversity and trees."
"C9. Prior to the commencement of the development hereby approved a tree planting plan shall be submitted to and approved in writing by the Department. The plan shall include the removal and planting of the existing access onto Ballafletcher Road. The plan shall adhere to the recommendations of BS8545:2014 (Trees: from nursery to independence in the landscape - recommendations) and in all cases shall include the following details: a) The exact location, species, nursery specification and planting specification of each tree to be planted. b) The approximate date when they are to be planted c) How they will be maintained until successfully established. The tree planting shall take place as agreed and any trees which, within a period of 5 years from their first planting, are removed, or, in the opinion of the Department, become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Department gives written consent to any variation.
Reason: to ensure that, within the site, the potential to mitigate the approved tree removal is maximised." 2.0 Proposal 2.1 The applicant's agent have now submitted the following:

Covered in these various plans and notes are tree planting proposals for the site including various sections and plans for various types of trees that are being planted. Also included are ecological technical notes which cover the locations of various proposed ecological mitigation measures, timescales for implementation as well as proposed maintenance measures.
3.0 CONSULTATION 3.1 The Ecosystem Policy team was consulted for advice on the satisfaction of the conditions. The advice received on 22nd May 2023, after their review of the submitted documents, concludes that they are pleased to confirm that the information satisfies the relevant clauses. The Eco Policy Officer did mention on their report: "To note, we have not yet seen details about the outdoor artificial lighting requirements for the site (see condition 12 of PA 21/01368/B). If outdoor lighting is required and plans

23/10035/AIR submitted to Planning, we may need to request changes to the locations of the various wildlife features, such as the bat boxes, to take into account the positioning of this lighting."
4.0 Recommendation 4.1 In this instance of the submitted plans as well as notes and after consultation with the case officer, who are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be satisfactory to discharge the planning condition 8 & 9 of application 21/01368/B. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
