SATISFACTION OF CONDITION 5
DESCRIPTION
1.1 Application PA22/00458/B was permitted via Principle Planner Sign-off on the 11th January 2023 subject to nine conditions, of which one required the submission of a bat survey prior to commencing works. Condition 5 stated the below,
"No development shall commence until a bat survey has been submitted to and approved in writing by the Department. The bat survey shall identify impacts on bat species together with mitigation, where appropriate, including a timetable for its implementation. The development shall not be carried out unless in accordance with the approved details.
Reason: To provide adequate safeguards for the bats."

PROPOSAL
2.1 The agent on behalf of the applicant has provided a bat survey dated 13th February 2023, of which a site visit was done by two members of the Manx Bat Group on the 9th February 2023.
CONSULTATION
3.1 No departments were consulted regarding the above condition.
ANALYSIS
4.1 The officer attached Condition 5 to the application based on the comments received from DEFA Ecology, of which their report states, "6.7 With regards the demolition of the existing cottage, there is a possibility that there may be bat roosts or bird nests within the structure, albeit no evidence of this has been witnessed by officers. The DEFA Biodiversity Officer highlights that there is a possibility of protected species, especially in the roof space and any approval should require an ecologist on-site survey prior to demolition. This is a prudent measure given that the date of demolition is not yet known and protected species can come and go. It is therefore recommended that the approval be controlled with a planning condition."
4.2 The findings of the bat survey are that there are no bats within the dwelling which is to be demolished, and that the proposed demolition will not impact any bat roosts.
4.3 Mitigation was suggested within the report which states that demolition should be done between April and September and that the provision of bat boxes should be welcome.
4.4 The information provided is suitable enough to provide evidence that the proposed demolition will not impact any roosting bats in the vicinity and as such is deemed to satisfy condition 5 of the application.
