Note. It is considered that the Land Contamination Assessment: Preliminary Risk Assessment and Generic Quantitative Risk Assessment prepared by GeoTick Ltd and dated December 2022 satisfies Condition 2 of the approval, although the condition will not be fully satisfied until such times as the works indicated on the plans have been carried out in full and retained as such.

SATISFACTION OF CONDITION 2
DESCRIPTION Demolition of existing buildings within yard and creation of residential development of 10 dwellings with associated roads, landscaping and parking.
PROPOSAL 2.1 This approval was granted on the conditions, inter alia, that: C 2. Site Characterisation (Contamination) The development hereby approved shall not commence until an investigation and risk assessment has been carried out and a report of the results has been submitted to, and approved in writing by, the Department. In the event that the assessment includes any

remediation measures the development shall not take place unless in accordance with these measures (including timescale). The investigation and risk assessment shall assess the nature and extent of any contamination on the site, and whether or not it originates on the site. The report of the findings must include the following information:
a) a survey of the extent, scale and nature of contamination; b) an assessment of the potential risks to: o human health; o property (existing or proposed) including buildings, crops, livestock; pets, woodland and service lines and pipes; o adjoining land; o groundwaters and surface waters; o ecological systems; c) an appraisal of remedial options, and d) the proposed remediation actions (if any) together with a timescale for their implementation.
Reason: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
2.2 The condition needs to be undertaken prior to commencement of development on site. The applicant has provided information to satisfy this conditions: notably; a. Agents Cover Letter which details condition to be determined and documents that have been provided to satisfy condition; b. Land Contamination Assessment: Preliminary Risk Assessment and Generic Quantitative Risk Assessment prepared by GeoTick Ltd and dated December 2022. This document details: i. Report Aims and Objectives; ii. Legal Context of Report and Methodology; iii. Details of Preliminary Risk Assessment carried out on site; iv. Details of Intrusive Site Investigation; which includes site investigation methodology, sampling and monitoring strategy, soil sampling, groundwater monitoring and sampling, ground gas monitoring, ground conditions and Hydrogeology. v. Generic Quantitative Risk Assessment (GQRA); which includes Laboratory Analysis of Soil Samples, Generic Assessment Criteria (GAC) Selection, Soil Analysis, Soil Analysis Summary, Ground Gas Monitoring, Meteorological Conditions, Site Gas Assessment, and Refined Conceptual Model. vi. Conclusion, Recommendations and Further Monitoring
CONSULTATION 3.1 DEFA Environmental Protection unit was consulted on the satisfaction of condition and reviewed the submitted Land Contamination Assessment. Their advice received 14 March 2023 concludes that the document and the testing all seems adequate for the site, and that EPU have no concerns.
RECOMMENDATION 4.1 The submitted Land Contamination Assessment is deemed sufficient to achieve the desired outcome as recommended by the case officer and would be satisfactory to discharge the planning conditions No.2 of this planning application.
4.2 It is, therefore, considered that the Land Contamination Assessment: Preliminary Risk Assessment and Generic Quantitative Risk Assessment prepared by GeoTick Ltd and dated December 2022, satisfies conditions 2 of the approval although this condition will not

be fully satisfied until such times as the works indicated on the documents and plans have been carried out in full and retained as such. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
