Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2 and Environment Policy 35.

Assessment

The proposal is to replace the existing third floor windows with white PVC slidling sash windows. The applicant has indicated that the windows will be similar to those fitted at second floor level. The proposal would be replicating the style and method of opening of the existing windows. The proposal would have a neutral effect on the character and appearance of the Conservation Area.

Recommendation

It is recommended that planning permission be granted subject to conditions.

Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Highways Division of the Department of Transport is now part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the installation of replacement windows as shown in drawing numbers 322 / 1 / 1,322 / 1 / 2,322 / 1 / 3 and 322 / 1 / 4 date stamped 13th December 2010.

C 3. The windows must replicate the windows in the second floor of the building.

I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
