C 1. The works hereby granted registered building consent shall be begun before the expiration of four years from the date of this consent.
Reason: To comply with paragraph 2(2)(a) of schedule 3 of the Town and Country Planning Act 1999 and to avoid the accumulation of unimplemented registered building consents.
This application has been recommended for approval for the following reason. The application meets the tests of section 18 of the Town and Country Planning Act 1999, as well as strategic policy 4 and environment policy 35 within the IOM Strategic Plan 2016 as the character of the conservation area is being preserved and protected. The applications is therefore judged to be acceptable.

Interested Person Status - Additional Persons
It is recommended that DOI Flood Risk Management Division should not be awarded party status as their comments do not concern a relevant issue set out within environment policies 30-35 and 39. __

Officer’s Report
1.0 THE SITE
1.1 The application site is a property called The Workshop, Victoria Terrace, Glen Road, Laxey. There are two existing buildings on the site; a two storey rendered stone building adjacent to the Glen Road boundary, and a single storey brick warehouse with an asbestos sheet pitched roof at the rear.
2.0 THE PROPOSAL
2.1 The application seeks registered building consent for the demolition of the rear workshop walls proposed to be replaced within planning application 23/00228/B to convert the property to a single dwelling.
3.0 PLANNING POLICY
3.1 TOWN AND COUNTRY PLANNING ACT 1999 S18 Designation of conservation areas (4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act.

4.0 PLANNING HISTORY
4.1 There are two previous applications on the site:
11/00246/A - Approval in principle to convert former workshop / store into a private dwelling - Permitted. A reserved matters application was never submitted in relation to this application.
90/04114/C - Change of use of joiners workshop to engineers workshop - Permitted on Review
5.0 REPRESENTATIONS Copies of representations received can be viewed on the Department's website. This report contains summaries only.
5.1 The DOI Flood Risk Management Division have made comments, initially objecting to the scheme and later (following the circulation of amended information) stating FRM firmly recommend that no sleeping accommodation be permitted on the ground floor of a property within a flood zone, and that FRM would insist on the FRA being conditioned should this Planning Application be permitted. Flood resistant materials, doors and electrics above flood level (13.3.2023, 5.5.2023 & 1.6.2023).
5.2 Garff Commissioners have stated that they have no objections to the proposals and recommend approval (29.3.2023).

5.3 Both DOI Flood Risk Management and Garff Commissioners submitted comments jointly for this registered building application and planning application 23/00228/B. The comments are considered to relate to the planning application rather than this registered building consent application for demolition elements.
6.0 ASSESSMENT
6.1 The existing walls of the rear workshop on the application site are constructed on exposed concrete blockwork. The walls are not traditional in their material, form, or style, and it is therefore judged that their removal would not have any negative impact on the special character of the conservation area.
7.0 CONCLUSION
7.1 It is judged that the application meets the tests of section 18 of the Town and Country Planning Act 1999, as well as strategic policy 4 and environment policy 35 within the IOM Strategic Plan 2016 as the character of the conservation area is being preserved and protected. It is therefore recommended that the application be approved.
8.0 INTERESTED PERSON STATUS
8.1 By virtue of the Town and Country Planning (Registered Buildings) Regulations 2013, the following are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) Manx National Heritage; and (c) The local authority in whose district the land the subject of the application is situated
8.2. In addition to those above, the Regulation 9(3) requires the Department to decide which persons (if any) who have made representations with respect to the application, should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
