Officer's Report
Introduction
- This application seeks approval for the installation of replacement windows in an end of terrace property situated in a predominantly residential area. The application is considered to be acceptable and in accordance with the relevant policies of the Isle of Man Strategic Plan.
The Site
- The application site is the curtilage of 22 High Street, Port St Mary which is a three storey property situated to the eastern side of the road. The property is an end of terrace, the row of terrace properties has retained much of their original character.
- The application property has timber sliding sash windows with Georgian glazing bars, the door is also fairly traditional.
The Rpoposal
- The application seeks approval for the installation of replacement windows in the front and rear elevations. The replacement windows would be white uPVC with Georgian glazing bars, they would be sliding sash opening.
Planning History
- The previous planning applications are not considered specifically material in the assessment of the current application.
Development Plan Policies
- The application site is in an area zoned as "Predominantly Residential" identified on the 1982 Development Plan. It is also zoned as "Mixed Use" identified on the Modified Draft Area Plan for the South 2011. It is also in the "Proposed Conservation Area". It is appropriate to consider Planning Circular 1/98 and Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).
- Planning Circular 1/98 i) Buildings in an urban setting
In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principle
elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.
Window not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction.
8. Environment Policy 35
Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
Consultations
- Port St Mary Commissioners have no objections.
Assessment
- The proposed windows in the front elevation would have similar glazing bars as the existing with the original method of opening. It is considered that the windows in the front elevation would be in accordance with Planning Circular 1/98 and would also be in accordance with Environment Policy 35 as the windows would preserve the original method of opening.
- The windows in the rear of the property would also preserve the original method of opening and would have similar glazing bars as the existing. It is considered that the windows in the front and rear of the property would preserve the character and appearance of the property and would contribute towards the proposed Conservation Area.
- For the above reasons the application is considered to be acceptable and is recommended for approval.
Party Status
- The local authority, Port St Mary is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1.
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2.
This permission relates to the installation of replacement windows to front and rear elevations as shown in drawings 0063, 0063A, 0063B, 0063C, 0063D and 0063E received 20th March 2012.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
