Tramman, Ballamanagh Road, Sulby, Isle Of Man, IM7 2hd
The proposal sought removal of condition 7 from the 1984 permission for Tramman, an estate manager's dwelling, which required it to be retained as part of the Ballamanaugh agricultural holding and not sold or let separately.

Normally resisting removal of agricultural ties but reasonable in this instance as long as agricultural worker tie is retained or imposed
Lezayre Parish Commissioners approved the application unanimously; public representations include support for retaining or replacing agricultural occupancy conditions, objection to removal as a step towards lifting occupancy restrictions, and a neutral comment on unrelated farm permissions.
Key concern: Removal of condition seen as first step towards removing Agricultural Occupancy condition

ObjectionThis would seem to be a first step towards seeking to remove the Agricultural Occupancy condition also applying to this dwelling.; I doubt if the 'Condition' now subject to an application to release would stand up in a Court of Law as being Legal anyway, particularly as no REASON whatsoever is quoted for applying it. Such bi-lateral Conditions have been extensively challenged and a quick search of the Journal of Planning Law would be wise.

Conditional No ObjectionWhilst normally resisting removal of agricultural ties to dwellings, in this instance it would seem reasonable as long as the more recent wording for an Agricultural Worker tie is either retained [from the documentation there appears to be one] or imposed in lieu of this restraint.
Conditions requested: the more recent wording for an Agricultural Worker tie is either retained [from the documentation there appears to be one] or imposed in lieu of this restraint.

No CommentI am aware of the property known as Tramman (and its agricultural occupancy condition) that is located in my parish, but given that this is some distance from my farm and I need to be within sight and sound of my stock, the Tramman property would not suit my requirements and is thus not a viable option for my enterprise.
