General Policy 2
GP2 permits development in accordance with land use zoning provided it respects site/surroundings (siting, layout, scale, form, design, landscaping), does not adversely affect townscape character, resident amenity, or road safety/traffic, and incorporates existing topography/landscape features like trees. The officer assessed the proposal against parts (b), (c), (f), (g), (h), (i), finding it compliant due to the site's camouflage, minimal change to quasi-industrial character, no amenity/highway impacts, and tree protection via existing fence. The policy was the key test as the use matches the Government designation.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Tree and fence protection
The protective security fencing that surrounds the site, and as part-shown on the approved drawing 01 (date-stamped as having been received 22nd March 2017) shall be retained during the construction of the building hereby approved. Any trees on the site that, within a period of 5 years from the completion of the development, die, are removed, or, in the opinion of the Department, become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Department gives written consent to any variation. Reason: In the interest of retaining an appropriately treed setting to the site and surrounding land in accordance with part (f) of General Policy 2 of the Isle of Man Strategic Plan 2016.
