The original application 16/00980/B for installation of jet wash units and associated facilities at Corkills Garage was granted permission by DEFA Planning. Local residents Mr and Mrs Clague appealed, arguing unacceptable noise exceeding WHO guidelines, inadequate noise assessment, water spray risks, and light pollution affecting their property at Seaview, 59 Governor’s Road. The inspector found the noise impact assessment inadequate and lacking site-specific data, concluding that noise from the unenclosed units sited close to the boundary would likely cause significant disturbance at Seaview, breaching GP2 and EP22. Water spray was also deemed likely to affect the neighbouring garden. Despite benefits as a public facility and no highway issues, the inspector recommended refusal; the Minister accepted this, reversing the approval on 4 September 2017.

This appeal demonstrates that inadequate, non-site-specific noise assessments are insufficient for contentious proposals near residences, even in mixed-use zones; future applicants must provide predictions at noise-sensitive receptors and consider enclosures or relocation to comply with GP2/EP22.
