Tel 01624 685950 Endless Design European House Peel Road Douglas IM1 5ED TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Kirindolam 2 Limited, Ref 16/00946/B, for the Conversion and erection of extension to former nursing home to provide thirty four residential apartments at Saddle Mews Nursing Home Groves Road Douglas Isle Of Man IM2 1HY subject to compliance with the following condition(s) and notes (if any) : 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. All soft landscape works shall be carried out in accordance with the Planting Specification details and associated plans 1612-P0005 and SK0001A all date stamped received 13 January 2017 and to a reasonable standard in accordance with the relevant recommendations of appropriate British Standards 5837: 2012. The works shall be carried out not later than the end of the first available planting season after completion of the development. Any trees or plants that, within a period of five years after planting, are removed, die or become, in the opinion of the Department, seriously damaged or defective, shall be replaced as soon as is reasonably practicable with others of species, size and number as originally approved, unless the Department gives its written consent to any variation. Reason: To ensure the provision, establishment and maintenance of a reasonable standard of landscape in accordance with the approved designs. 3. The proposed cellular confinement system under P01, as shown on drawing P0101 dated 2 March 2017, shall be implemented in conjunction with the Planting Specification details and associated plans 1612-P0005 and SK0001A all date stamped received 13 January 2017. The cellular confinement system shall be permanently retained in accordance with the approved details. Reason: To ensure that planting in this area is not adversely affected by any underground works.

The development hereby approved shall not be occupied or operated until the parking and turning areas have been provided in accordance with the approved plans. Such areas shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times. Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety. 5. The development shall not be occupied or operated until the secure bicycle store and motorcycling parking bays have been provided in accordance with the approved plans. The secure bicycle store and motorcycling parking bays shall be retained at all times thereafter. Reason: To promote sustainable travel in the interests of reducing pollution and congestion. 6. Details of all hard landscaping shall be submitted to and approved in writing by the Department showing details of existing and proposed walls, fences, ground levels, other boundary treatment and hard surface treatment of the open parts of the site, and a programme of implementation. The measures shall be implemented in accordance with the approved details prior to the occupation of the development and shall thereafter be retained. Reason: In the interests of the appearance of the development and the surrounding area. Tel 01624 685950 Guidance Note This decision was made by a Senior Planning Officer in accordance with the authority delegated to them in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2016 (currently £170); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ The proposed development must not be commenced until either; · The time for requesting an appeal has expired; or · Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
