Officer’s Report
THE SITE 1.1 The site is a section of Marina Road which stretches 19m from St. Thomas' Walk to the pedestrian walkway which follows the highway at the junction of the Promenade and Church Road. The application site is a pedestrianised street. Much of Strand Street, Duke Street and Regent Street have been re-finished in the same material as is proposed here and was able to be undertaken without the need for planning approval as this fell within the range of highway works which can be done by or on behalf of the Department of Infrastructure. The regeneration paving is proposed to be continued along Castle Street and Marina Road but planning approval is required for the stretch in front of Sam Webb's public house as this lies within the Douglas Promenades Conservation Area.
THE PROPOSAL 2.1 Proposed is the continuation of the re-paving of the pedestrianised street using granite setts in two sizes separated by two 250mm wide granite channels as has been laid along Strand Street.
2.2 The new material will replace the pink coloured paviours which were laid in the 1970s and early 80s.
PLANNING POLICY 3.1 The site is within an area designated as Predominantly Shopping on the Douglas Local Plan of 1998 and within the Douglas Promenades Conservation Area. Development here is therefore required to be accessible to all users and should preserve or enhance the character or appearance of the Conservation Area (GP2, Transport Policies 4, 5 and 6 and Environment Policy 35, which echoes the provisions of the Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man.
3.2 The Conservation Area Appraisal does not refer to this part of the Area in any detail.
PLANNING HISTORY 4.1 The site has not been the subject of any previous applications.
REPRESENTATIONS 5.1 Douglas Borough Council support the application (28.07.17).

6.1 The existing surface is dated and is in need of rejuvenation. What is proposed will tie in with the rest of the pedestrian environment along Castle and Strand Streets and will enhance the pedestrian environment and will provide a more uniform surface on which pedestrians and those with prams and in wheelchairs can travel more comfortably.
6.2 The scheme will enhance the appearance and character of the area and whilst it is within a Conservation Area, the character of the application site is flanked by relatively modern buildings and where modern materials as proposed will not be out of place.
INTERESTED PERSON STATUS 7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
List any Depts who do not raise material considerations and who should not be afforded interested person status under the Order.
In addition to those above, article 6(3) of the Order requires the Department to decide which persons (if any) who have made representations with respect to the application, should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application.

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
