Officer’s Report
THE SITE 1.1 The site is the residential curtilage of an existing dwelling which sits to the south of Erin Lane, just before its junction with Erin Way in Port Erin. The house is one of the largest in the streetscene with a plot width of 15m. The house is as it was when approved in the 2000s, a rectangular footprint with a single storey garage to the west. The rear side boundaries are formed by various shrubs.
THE PROPOSAL 2.1 Proposed is a rear extension which projects out from the rear elevation by 4m and will be 4.6m wide with a pitched roof which is 2.3m to the eaves and 3.8m to the top of the ridge. The extension will be offset from the eastern gable by 1.2m and will be 2.5m from the boundary with number 4. Number 4 in turn has a rear conservatory which is 1.5m from its boundary with number 6.
2.2 The extension will provide a sun lounge, with windows in the rear, two narrow windows in the side facing towards the boundary with number 4 and a set of patio doors in the side facing towards the south west (number 35, Erin Way) which is 9m away.
PLANNING POLICY 3.1 The site lies within an area designated on the Area Plan for the South (2013) as Residential. As such, the appropriate part of the Strategic Plan to be applied is as follows:
8.12.1 Extensions to Dwellings in built up areas or sites designated for residential use As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general.
General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape and (g) does not affect adversely the amenity of local residents or the character of the locality."

4.1 Port Erin Commissioners support the application (13.07.17).
4.2 Highway Services indicate that there is no highway interest in the application (19.07.17).
ASSESSMENT 5.1 The issues here are whether the extension will adversely affect the living conditions of those in nearby dwellings. A public footpath runs to the rear of the property from where the extension could be publicly visible but in any case is neat and well designed.
5.2 The extension will be a reasonable distance from neighbouring property, more than many rear extensions on properties in this area and as such, it is not considered that the extension would have any adverse impact on those in neighbouring property. A very similar structure could be erected without planning approval under the terms of The Town and Country Planning (Permitted Development) Order 2012.
5.3 The application is recommended for approval.
INTERESTED PERSON STATUS 6.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
