The principle of the development is acceptable as it accords with the 'Harbour Area' zoning in the Douglas Local Plan and complies with General Policy 2 criteria, including respecting site surrounding…
General Policy 2
Requires proposals in accordance with zoning to respect site surroundings in siting, scale, form, design; not adversely affect townscape, public sea views, amenity, access, road safety, or community safety. The officer assessed the smaller replacement office as compliant, noting it fits within the operational harbour site without adverse impacts, supported by consultee comments.
Environment Policy 29
Requires advice on Hazard Consultation Zone applications with public health and safety overriding; conflicting developments not permitted. Assessed as compliant since the office is ancillary to the hazard-generating use, does not increase personnel in the zone, and DEFA Health & Safety confirmed no concerns.
Transport Policy 13
Seeks to protect harbours from development undermining viability or character. The relocation within the operational site was found acceptable, maintaining harbour function and character.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Ancillary use only
The development hereby approved shall only be used in connection with the wider site and not as a separate office use. Reason: The office is located within a Hazard Consultation Zone, however as it is functionally related to the use of the area which results in it being a Hazard Consultation zone it is acceptable as an ancillary use.
Removal when no longer required
The development hereby permitted shall be removed from the site when no longer required. Reason: The development is a prefabricated building.
