The principal issue was whether material planning matters had changed since the 2013 approval of PA 12/01690/B, such as policy changes, land use designations, Local Plan adoption, or new legislation.
Residential Policy 1 of Laxey and Lonan Area Plan Order 2005
Policy permits residential development only in designated existing/proposed residential areas; alterations/extensions to existing properties accepted if sympathetic to character. Site is in predominantly residential use area; proposal is variation for replacement dwelling already approved as compliant.
General Policy 2
Requires development to respect site/surroundings in siting, scale, design; not adversely affect character, amenities, highway safety, parking, or prejudice adjacent land. Officer confirmed ongoing compliance as per original approval, with no changes to warrant refusal; parking meets 2-space standard.
Housing Policy 6
Residential development in zoned land must follow area plan brief or criteria for good design. Site zoned residential; no issues with design as previously accepted.
Transport Policy 7
Requires parking per standards (2 spaces per dwelling, one in curtilage). Proposal provides two on-site spaces accessing highway; Highways Services no objection.
Time limit
The development hereby approved shall be begun before the expiration of two years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Frosted glass privacy screen
Prior to the first occupation of the dwelling, the glass screen positioned at the northern end of the lower ground floor terrace, as shown on drawings P10-04 rev A and P12-01 Rev A, both dated stamped 9th March, 2017, must be erected and glazed using frosted glass. The level of obscuration used must be no less than level 5 as detailed on Pilkington's textured glass range, or equivalent. This glass screen must be retained as such thereafter. Reason: in order to maintain the privacy of those in adjacent property.
