Officer’s Report
THE SITE 1.1 The site is the curtilage of the Shoprite supermarket situated on the northern side of Derby Road in Peel, within a car park which mostly serves the shop. The building is a modern one, single storey but with rooflights illuminating the shop floor within. The building has a slate-like roof and mainly rendered walling with a plinth and some vertical elements of the walling finished in red/brown brick.
1.2 The site has a "shoprite" sign mounted on the main entrance which faces northwest, into the car park which comprises individual letters in orange and green with an overhead external light and another on the elevation facing Derby Road.
THE PROPOSAL 2.1 Proposed are three signs, all advertising the "Subway Cafe" service which is available in store. One sign will be affixed to the elevation alongside the main entrance facing Derby Road, another on the elevation facing into the car park and a third at the south eastern end facing Derby Road. All signage will be individual lettering with a strip external illumination above. The lettering will be 2mm brushed stainless steel and 400 - 550mm high with the sign overall being 550mm high and 3000mmm wide with the smaller "cafe" sign underneath being 400mm high and 1200mm wide. The illumination will be directed to the sign only.
2.2 The applicant has indicated that they would be prepared to accept a condition which limits the illumination of the new signage to bring it in line with what currently happens on site - that is, at 2215hrs. The store opens at 0800hrs daily.
PLANNING POLICY 3.1 The site lies within an area designated on the Peel Local Plan as Retail. The proposal is consistent with this and as such, General Policy 2 of the Strategic Plan which requires that development does not affect adversely the character of the surrounding landscape or townscape nor the amenity of local residents or the character of the locality. There is also specific advice in the SP about signage, as follows:
General Policy 6: Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
(a) are of a high standard of design and materials and relate well to the building and site on which they are to be displayed; (b) are in keeping with and do not detract from the surrounding area; and

(c) are located so as not to cause a highway safety hazard.
PLANNING HISTORY 4.1 The site has been used as a supermarket for some time, with recent extensions having been completed as approved under 08/01260/B and a more recent application for the Shoprite signage referred to above, approved (10/01785/D).
REPRESENTATIONS 5.1 The owner of Rose Cottage which sits opposite the site on the south western side of Derby Road does not object to the application but asks that the illumination is switched off when the cafe is not operational (28.04.17).
5.2 Highway Services indicate that they have no highway interest in the application (12.05.17).
ASSESSMENT 6.1 The issues in this case are whether the proposed signs are appropriate to the character and appearance of the building and its setting in the streetscene and also whether there would be any adverse impact on the amenities of those living opposite the site.
6.2 It is reasonable to seek a time when the illumination is extinguished even if the main signage illumination is not controlled. Subject to this, the lighting is considered reasonable and acceptable and is recommended for approval.
INTERESTED PERSON STATUS 7.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant’s agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Persons to whom notice has been given under regulation 10(3)(a)(i) (d) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; (e) The Highways Division of the Department of Infrastructure; (f) The Ports Division of the Department of Infrastructure; (g) The operator of the railway or tramway; and (h) The local authority in whose district the land the subject of the application is situated.
7.2 In addition to those above, the Regulation 11(3) requires the Department to decide which persons (if any) who have made representations with respect to the application, should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application.
In this instance, it is recommended that the following persons have sufficient interest and should be awarded the status of an Interested Person:
The owner of Rose Cottage who is directly opposite the site.

C 1. The advertisement(s) hereby granted consent shall be begun before the expiration of four years from the date of this notice.
Reason: To avoid the accumulation of unimplemented advertisement consents.
C 2. The illumination on the signage hereby approved must not be illuminated later than 2215hrs nor before 0800hrs on any day.
Reason: in order not to adversely affect the character of the area nor the living conditions of those in nearby properties.
This approval relates to drawing P01 received on 21st April 2017.
