General Policy 3
Seeks to control development in the countryside. Officer found proposal failed as agricultural need still existed on the farm and locality; Committee deemed exceptional circumstances justified removal while supporting agricultural aims.
Environment Policy 14
Requires demonstration that agricultural dwellings are no longer needed. Assessed against long-term need both on the particular farm (applicants wished to expand) and locality (other tied dwellings and recent approvals noted); evidence insufficient per officer.
Housing Policy 8
Mandates occupancy restriction to persons engaged in agriculture for approved agricultural dwellings. Policy tested via evidence of ongoing need; removal not usually granted without proof need no longer warrants reservation.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Suspension of permitted development rights
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any Order revoking and/or re-enacting that Order with or without modification), no garages or other free standing buildings shall be erected within the curtilage of the dwelling known as Cronk Mooar, other than that expressly authorised by this approval, without the prior written approval of the Department. Reason: To control development in the interests of the amenities of the surrounding area.
