Tel 01624 685950 Carl Jenkins Design 10 Church Street Peel Isle Of Man IM5 1HL TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Mike Brereton, Ref 16/00205/B, for the Erection of a detached dwelling (comprising amendments to approved PA 12/00658/B) at Land Adjacent To Westwood New Road Laxey Isle Of Man subject to compliance with the following condition(s) and notes (if any) : 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. Prior to the occupation of the dwelling the visibility splays onto New Road must be set out and thereafter maintained in accordance with drawing no.s 02 and 04 date stamped the 22nd February 2016. Reason: In the interests of highway safety. 3. The dwelling hereby approved shall not be occupied until the parking and turning areas for both the approved dwelling and Westwood have been provided in accordance with the approved plans. Such areas shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times. Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety. 4. Obscure glazing (Pilkington level 5 or equivalent) shall be installed in the north- western elevation of the first floor bathrooms and bedroom window and shall be maintained as such thereafter. Reason: To preserve the amenities of the occupants of the adjacent dwelling. 5. Prior to the commencement of any works hereby approved a detailed scaled plan is required to be submitted to and approved in writing by the Department which shows a 1.5 metre high obscure glazed screen positioned along the north-western edge of the roof

Tel 01624 685950 terrace above the garage. This plan should also include details of the boundary treatment between the dwelling hereby approved and Westwood. These approved schemes are required to be implemented prior to the occupation of the dwelling and maintained and retained thereafter. Reason: To preserve the amenities of the occupants of the adjacent dwelling. This approval relates to drawings reference numbers 01, 02, 03, 04 and SVY-1 REV A all received on 22nd February 2016. Date of Issue: 18th April 2016 Interim Director of Planning and Building Control Guidance Note This decision was made by a Senior Planning Officer in accordance with the authority delegated to them in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2015 (currently £165); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ The proposed development must not be commenced until either; · The time for requesting an appeal has expired; or · Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
