Officer’s Report
THE SITE 1.1 The site is the curtilage of the former Viking Long House which was redeveloped to apartments under PAs 05/01363/B, 06/01028/B and 08/00186/B and subsequent alterations to the scheme. The application relates to unit 1 which is on the first floor and stretches back from East Quay in an L shape. Currently the property has patio doors which lead out onto a small patio and this patio also has a window which looks upon it.
1.2 The front of the unit is visible from the Quay although the part of the unit which is the subject of this application is set back by over 20m and consequently less prominent. At present, the balcony railings screen the lower side of the wall beneath the existing window which is to be replaced, making it unclear whether this is a window or a door.
THE PROPOSAL 2.1 Proposed is the replacement of this window with patio doors to match others within the building. The door will be the same width as the window.
PLANNING POLICY 3.1 The site lies within an area designated as Mixed Use on the Peel Local Plan of 1990 and also lies within the town's Conservation Area. As such, the proposal must preserve or enhance the appearance of the area and not result in any adverse impact on the living conditions of those in adjacent property, in accordance with Environment Policy 35 and General Policy 2 of the Strategic Plan.
REPRESENTATIONS 4.1 DoI Highway Services indicate that they have no highway interest in the application (18.08.16).
ASSESSMENT 5.1 The window is not on the front facade of the building although is visible to those passing by on East Quay. Furthermore, what is visible now is not easily discernible as a door or a window. As such, the impact of the proposal is slight and not adverse, considering the existence of other similar doors alongside.
5.2 The application is recommended for approval.

7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material, in this case Highway Services and (e) The local authority in whose district the land the subject of the application is situated.
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
