The Site
The application site is the curtilage of 15 Princes Street, Douglas. The existing property is a three storey mid terrace situated to the South of Princes Street.
The Proposal
Proposed is the installation of a replacement ground floor window in the front elevation. The replacement window would be a uPVC top opening casement which would be centre transom.
Planning History
The previous planning application is not considered specifically material in the assessment of the current application.
Development Plan Policies
The application site is within an area zoned as "Predominantly Residential" identified on the Douglas Local Plan 1998. Given the nature of the application it is appropriate to consider Planning Circular 1 / 98.

ASSESSMENT Given the nature of the application it is appropriate to consider Planning Circular 1/98 which states: "In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows."
The existing window in the ground floor front elevation is not the original and does not contribute towards the character and appearance of the property or the surrounding area.
The proposed window would be uPVC top opening casement window, which would be centre transom. Given that the window would have a 50/50 split it would replicate the glazing sections of sliding sash windows.
Many of the neighbouring properties within the street scene have u PVC top opening casements, it is considered that the proposed window would be in keeping with the surrounding properties and it would not be detrimental to the character and appearance of the area.
For the above reasons the application is considered to be acceptable and is recommended for approval.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
