Tel 01624 685950 Mr Steven Curphey Ballamoar Farm Ballamoar Lane Ballaugh IM7 5EE TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Steven Curphey, Ref 16/00545/B, for the Installation of two glamping pods, decking, fences, gardens and fifteen electrical hook up points (retrospective) at Campsite Field 221335 Ballaugh Glen Road Ballamoar Farm Ballaugh Isle Of Man subject to compliance with the following condition(s) and notes (if any) : 1. The glamping pods on the site shall not be occupied as a person's sole or main place of residence. Reason: To ensure that the approved holiday accommodation is not used for permanent residential occupation. 2. The external finishes of the glamping pods and associated structures must be painted or stained dark brown, and thereafter retained as such. None of the glamping pods hereby permitted shall be replaced by any other structure(s) or caravan(s) differing from the approved details. Reason: In the interests of the character of the area and for the avoidance for doubt, to ensure that the camping pods continue only to provide simple holiday accommodation akin to a tent broadening the range of affordable tourism accommodation available. 3. The electrical hook-ups and fire points shall be removed during the permitted closed period and the site must be used for agricultural purposes or as open space. Reason: In the interests of amenity, in order to secure the removal of equipment during the closed period as the application has been assessed on a seasonal operation. 4. In the event that the glamping pods are not used as such for a period of 12 consecutive months or longer they must be removed from the site and the land restored to grassed area/agricultural. Reason: In the interests of amenity, in order to secure the restoration of the land upon removal/extinguishment of a building/use for which permission can be justified only on the basis of a special need.

The glamping pods shall not be used between second Monday in October in any one year and last Friday in April, in the succeeding year, with the exception of Easter Weekend. Outwith this time the site must be used for agricultural purposes or open space. REASON: The site lies within an area where it is against the policy of the Department to allow permanent accommodation without a special agricultural (or other proven, local) need. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2015 (currently £170); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ The proposed development must not be commenced until either; · The time for requesting an appeal has expired; or · Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
