Re: Proposed change of use from warehouse/light industry into Office accommodation at 2A Berkeley Street Lane, Douglas, Isle of Man for Mr Edward Joyce.
Planning Application Letter of Support.
A retrospective planning application was submitted to the Planning Authorities on 8th December 2010 for alterations, creation of a ground floor training area and self contained flat above. Following discussions with the Planning Officer Mr Ian Brooks and his indication that this application report would be to recommend refusal as the flat accommodation fell within an area of commercial/light industrial use. Following on from this, the client informed that he wished to have the application withdrawn to allow reconsideration of the application and use of the building.
It was pointed out by Mr Ian Brooks that the only residential accommodation in the entire block of properties between Albany Lane and Berkeley Street Lane was at 1 Albany Street and that all other properties were of a commercial nature. The enforcement part of this application centered on the illegal change of use from the previous light industrial use into flat accommodation set over the first and second floors of the existing building, at 2 Berkeley Street Lane.
We understand from our client that previous use of this part of the building was as a joinery workshop, warehouse and associated office (under class 5). This new submission requests a change of use from the original workshop and warehouse into separate office accommodation under class 4 of the Use Classes Order removing the original planning concerns identified with regards to the residential accommodation.
The shop unit at 1 Albany Lane was approved under planning application no. 08/02133/B and still falls under Class 1 shops. No change is therefore required and 1 Albany Lane does not form part of this application. Additionally the existing dwelling was approved under the same application and does not require any alteration.

The Ground floor of 2 Berkeley Street is to be utilised in conjunction with the shop unit at 1 Albany Street as a small staff training area to periodically instruct employees in methods of office cleaning and the health and safety issues associated with cleaning operations and materials. The covered yard area in the rear part of the building towards Berkeley Street Lane would be utilised for keeping the cleaning equipment and materials. Looking to the use classes order, we consider that the use of this part of the building does not change from that of the previous class ie Class 5 as the cleaning instruction would fall under the development of a process and the previous use as a joinery workshop would fall under light industry both identified under this same class.
Our application therefore would only involve the access off Berkeley Street Lane and the First and Second floor accommodation to form new Office accommodation in place of the previous use.
We respectively request that this supplementary information be considered in support of our planning application and would be obliged if you could place this application on the Agenda of your next Planning Committee meeting and advise us of the outcome in due course.
