1.0 THE SITE 1.1 The application site is the curtilage of 8 Lyndale Avenue, Peel which is a mid terrace property situated to the south eastern side of the highway. The application site is within the Peel Conservation Area.
2.0 THE PROPOSAL 2.1 The application seeks permission for Application for a Certificate of Lawful Development for the installation of replacement windows to rear elevation.
3.0 PLANNING STATUS 3.1 The application site is within an area zoned as "Predominantly Residential" identified on the Peel Local Plan 1989. It is also within the Peel Conservation Area.
4.0 PLANNING HISTORY 4.1 The previous planning application is considered specifically material in the assessment of the current application:- 4.2 Installation of replacement windows to UPVC at front elevation - 02/00913/B - APPROVED
5.0 CONSULTATIONS 5.1 No comments have been recived.
6.0 ASSESSMENT 6.1 The assessment of the application requires the examination of the information available in order to determine whether there is either sufficient or insufficient evidence, that on the balance of reasonableness the development has been in excess of 4 years. Under Schedule Part 1, Paragraph 3 (a) of the Town and Country Planning Act 1999 no enforcement notice may be issued in respect of a breach of planning control consisting of the carrying out without planning approval of building, engineering, mining or other operations in, on, over or under land, after the end of a period of 4 years beginning with the date on which the operations were substantially complete.
7.1 The then owner has since passed away (Dorothy Evelyn Lancaster - died 28th December 2011), and the owners son (Mr David Lancaster) is in the process of selling the property. During this proposes it has a risen that permission whilst sought for the front windows in 2002, the rear windows do not benefit from any planning permission. The applicant in their submissions has stated that the windows to the rear of the property were undertaken in 2009. 7.2 The applicant has provided a a copy of an Invoice (dated 17th February 2009 as attached) from Keltic Windows Ltd., who supplied the windows to the son of the late Mrs Lancaster, namely Mr David Lancaster, who lived and resided at the above premises during his mother's lifetime, up to a short time ago. The applicant has indicated that the windows in question, were fitted to the rear of the property on Mr Lancaster's supervision and instructions, shortly after receipt of the window units. The work was not undertaken by Keltic Widows Ltd, but the installation was supervised by Mr Lancaster. A copy of a cheque payment dated 5th March 2009, is also attached as evidence of payment of the units. 7.3 Visiting the site it seems apparent that the windows were installed a number of years ago and not recently, however it is not possible to determine exactly how long they have been in place.
8.1 Based on the evidence which has been submitted as part of the application, it is considered that on the balance of reasonableness it has been adequately demonstrated that the installation of replacement windows to the rear have been in situ for a period of time in excess of 4 years. As such it is recommended that the application be permitted and a Certificate of Lawful Development be issued.
9.1 It is considered that the development is lawful and as such a Certificate of Lawful Development should be issued.

C 1. The submitted application contains evidence sufficient to demonstrated that the installation of replacement windows to the rear elevation of the dwelling which is identified by the red line on
the Location Plan date stamped 28th August 2013, have been completed for a period in excess of four years.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
